PROMOTION TERMS AND CONDITIONS

1. The “Reddy, Set Peel & Win with Shell Reddy Express” (“Promotion”) is conducted by Viva Energy Retail Pty Ltd (ABN 96 662 372 027) of Level 16, 720 Bourke Street, Docklands, VIC 3008 (the “Promoter”). For the purposes of this Promotion, the Promoter has engaged certain suppliers, including Creata Marketing Pty Ltd (“Creata Marketing”), to conduct certain aspects of this Promotion and Entrants may be contacted by such suppliers in connection with the Promotion.
2. Information on how to enter and the prize(s) form part of these Terms and Conditions, and a copy of the Terms and Conditions can be located on www.reddyexpress.com.au (the “Promotional Website”).  Entry into the Promotion is deemed acceptance of these Terms and Conditions by each Entrant.
3. In these Terms and Conditions, Shell Reddy Express and Shell Coles Express sites that feature material advertising the Promotion are participating in the Promotion and are referred to as “Participating Outlets”.

PROMOTIONAL DATES

4. The Promotion starts at 12:01am (Sydney time) on 3 July 2025 and ends for purchases at 11:59pm (Sydney time) on 3 September 2025 (the “Purchase Period”). All prize claims and entries into the unclaimed prize draw must be made by Entrants by no later than 11.59pm (Sydney time) on 30 September 2025. 

5. Entrants who purchase Bonus Products (as defined below) during the specific dates set out in clause 14 within the Purchase Period, will be eligible to receive additional entries, as set out in clause 14 (each a “Bonus Purchase Period”).

ELIGIBILITY

6. Entry is only open to Australian residents aged 16 years or over as at the time of entry, who remain Australian residents for the duration of the Promotion (including at the time they claim any prize, if a prize winner) (“Entrants”).

7. Entrants under 18 years old must have parental/guardian approval to enter the Promotion and provide personal information about themselves.  All entries of Entrants who are aged less than 18 years who enter the Promotion while attempting to conceal (or without disclosing) their age (as and where required) will be deemed invalid.  These Terms and Conditions will bind the Entrants and any parent or legal guardian who gives their consent (for Entrants aged less than 18 years).  Persons who are aged less than 16 years old are ineligible to enter and participate in the Promotion.  All entries and attempted prize redemptions of persons who are aged less than 16 years old will be deemed invalid.

8. The directors, management and employees (and their Immediate Family) of the Promoter, its related entities, related bodies corporate or Participating Outlets, and printers, suppliers, providers, software providers, developers and agencies associated with this Promotion are ineligible to enter the Promotion.  

9. “Immediate Family” means any of the following: spouse, ex- spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1^st cousin.

HOW TO RECEIVE A GAME CARD

10. Subject to clause 12, to be eligible to enter and receive a game card, while stocks of those game cards last, individuals must spend $10 or more in one transaction on fuel and/or eligible in-store products (excluding purchases made with Fleet Card, Motorcharge or Motorpass), at a Participating Outlet during the Purchase Period (“Qualifying Transaction”).  Qualifying Transactions made via the DoorDash, Uber Eats and Menulog platforms from Participating Outlets will also be eligible for the Promotion. Any DoorDash, Uber Eats or Menulog transaction fees (such as delivery and service fees) will not be counted toward the minimum $10 spend in a Qualifying Transaction. Game cards are strictly limited. 

11. For the avoidance of doubt, Qualifying Transactions made using a Shell Card will be eligible for entry into this Promotion. In such case, the game card will be handed to the individual making the Qualifying Transaction, regardless of whether that individual is the account holder of the Shell Card.  

 

12. A Qualifying Transaction excludes: 

(a)      purchases made at any other sites;

(b)      lubricants and additives, including without limitation, AdBlue; 

(c)      tobacco and tobacco-related products; 

(d)      gift cards including, without limitation, Apple gift cards; 

(e)      calling cards; 

(f)       trailer hire; 

(g)      lottery deposits; 

(h)      charity donations;

(i)       mobile phones;

(j)       mobile phone plans and recharges of those plans; and

(k)      Opal card top-ups.

13. Subject to these Terms and Conditions, including clause 14, only one (1) game card will be awarded for each Qualifying Transaction, while stocks of game cards at each Participating Outlet last.   

14. Entrants who purchase a product from the bonus partners’ range (“Bonus Product”) as part of a Qualifying Transaction during the Bonus Purchase Period for that Bonus Product will receiveone (1)additional game card for every Bonus Product purchased in that Qualifying Transaction . The bonus partner range includes:

            (A) For the Bonus Purchase Period from 3 July to 3 September 2025:

1. V 250ml and 500ml varieties;
2. Celsius 330ml varieties;
3. Cola Cola Kirks, Fanta and Sprite 600ml varieties;
4. Red Rock Deli 165g varieties; and
5. Smiths/ Twisties/ Doritos/ Cheetos/ Burger Rings 80 - 90g;
   
    

(B) For the Bonus Purchase Period from 3 July to 6 August 2025:

(C) For the Bonus Purchase Period from 7 August to 3 September:

h. Dare 500ml varieties;

i. Mars Large Bar 60 - 64g varieties and Medium Bitesize 120g - 180g varieties; and 

j. Muscle Nation bars 50 - 60g varieties, Muscle Nation Energy drink 500ml varieties and Muscle Nation Protein Puff 60g varieties.

15. The choice of eligible products and Bonus Products is subject to availability at each Participating Outlet and is based on reasonably anticipated demand. Each eligible product and Bonus Product may not be available for sale in all Participating Outlets at all times during the Purchase Period. The Promoter accepts no responsibility for any eligible products being unavailable at a Participating Outlet during the Purchase Period and/or Bonus Products being unavailable at a Participating Outlet during a Bonus Purchase Period.

HOW TO CLAIM A PRIZE 

16. Entrants must peel their game card/s to reveal whether or not they have won an instant prize. Instant prizes include: 

(a)      in-store redemption prizes (“In-Store Prizes”); and 

(b)      prizes that must be redeemed online, via the Promotional Website (“Online Prizes”).

How to claim an In-Store Prize

17. In-Store Prizes include the prizes listed in clause 42, under the heading “In-Store Prizes.  In-Store Prizes can be either redeemed instantly at the same time the Qualifying Transaction is made and the Entrant is deemed an instant prize winner, or at the Entrant’s next visit to a Participating Outlet, by close of business on 30 September 2025. In-Store Prizes that are fuel discounts can only be redeemed at the Entrant’s next visit to a Participating Outlet, and must be redeemed by close of business on 30 September 2025. 

18. If an Entrant’s game card reveals an In-Store Prize, to claim that In-Store Prize, Entrants will need to surrender a portion of their winning game card to a member of staff at the Participating Outlet.  All claims for In- Store Prizes must be redeemed by 11:59pm (Sydney time) on 30 September 2025).  Entrants will need to retain the remaining portion of the game card for the purposes of entering the unclaimed prize draw.

19. An In-Store Prize may only be redeemed once using the original winning game card.

20. In-Store Prizes that are food or beverages may only be claimed when the relevant Participating Outlet has that food or beverage in stock. If the product won is not available, customers can redeem it at another Participating Outlet with available stock or they can choose to accept an alternative prize of equal or higher value offered to them in store. 

21. In-Store Prizes that are not claimed in the time and manner specified in these Terms and Conditions and by 30 September 2025 will be deemed forfeited. The Promoter’s decision is final and no correspondence will be entered into.

How to claim an Online Prize

22. Online Prizes include prizes that cannot be redeemed in-store at a Participating Outlet, as listed in clause 42 under the heading “Online Prizes”. Employees and managers of Participating Outlets are only authorised to accept claims for In-Store Prizes and have no authority to verify any Online Prize, or to accept any claims for Online Prizes.

23. If an Entrant’s game card reveals an Online Prize, to claim that Online Prize, an Entrant must, by 11.59pm (Sydney time), scan the QR code on the game card or visit the Promotional Website and correctly and successfully follow the directions provided via the Promotional Website in the manner required to:

1. enter their unique prize code into the Promotional Website;

b. enter the unique entry code, for entry into the unclaimed prize draw (located on the inside of the game card below the QR code);

c. provide their personal information when requested by the Promotional Website. The personal information that must be provided is dependent on the Online Prize won and may include:

1. first and last name;
2. date of birth;
3. telephone number;
4. postal address and/or residential address (used only where a physical prize needs to be posted);
5. current and valid email address;
6. if they are aged less than 18 years of age, details of their parent and legal guardian, together with written confirmation of their parent’s or legal guardian’s consent to enter the Promotion; and
7.  if required by the Promoter, proof of their eligibility to enter into the Promotion in accordance with these Terms and Conditions;

d. upload a copy of the game card, clearly showing the unique code and the Online Prize won; 

e. verify their identity and prize claim in the manner requested;

 

1. For Online Prize claims over $1,000: Online Prize claims over $1,000 will be verified via GreenID®, copy of game card, statutory declaration and capturing an Entrant’s unique IP address; or 
2. For Online Prize claims (regardless of value): the Promoter reserves the right to require provision of the original physical peel game card, and in the event of a dispute, reserve the right not to award a prize, and

f. accept the Terms and Conditions and the Promoter’s Privacy Policy and submit the fully completed submission form. 

g. Upon completion of the steps in this clause 23, Entrants will be directed to check their nominated email for instructions on how to verify and/or redeem their claim or Online Prize (“Verification Email”).

24. All claims for Online Prizes must be made by an Entrant through the Promotional Website by 11:59pm (Sydney time) on 30 September 2025. The Entrant must complete any Online Prize verification steps set out in the Verification Email within the time frame specified in the Verification Email. The Promoter may, in its absolute discretion, allow a longer time period for Online Prize verification on an individual basis, however is under no obligation to do so.

25. Online Prizes that are not claimed as directed will be forfeited, subject to the unclaimed prize draw clause.

26. A unique prize code cannot be used to claim more than one (1) Online Prize in the Promotion.   

27. IMPORTANT: If an Entrant does not receive a Verification Email within one (1) business day of submitting the website claim submission, the claiming Entrant (or their parent or legal guardian where the Entrant is less than 18 years of age) MUST contact Creata Marketing within the one (1) business day in order to be eligible to claim the relevant Online Prize, subject to the Promoter’s sole discretion on later response timings.

28. If the Promoter does not recognise a unique prize code submitted by the Entrant via the Promotional Website, the Entrant will be prompted to check the relevant game card and resubmit the unique prize code listed on that game card in the required manner.  If the Entrant re-submits the unique prize code five (5) times, and each time the Promoter does not recognise the unique prize code submitted, the Entrant can seek support by contacting Creata Marketing. 

29. Creata Marketing can be contacted at either https://www.creata.com.au/ or +61-426 152 113. Creata Marketing will be open Monday to Friday between 8am to 5:30pm (Sydney time) and on weekends and any Australian State or Territory public holiday between 9am to 6pm (Sydney time).

30. The Promoter and/or its nominated agent will award Online Prizes to those Entrants who satisfy these Terms and Conditions no later than 31 October 2025.

HOW TO ENTER THE UNCLAIMED PRIZE DRAW

31. Online Prize winners will also be entered into the unclaimed prize draw when they complete the steps set out in clause 23 (including providing the unique entry code located on the inside of the game card below the QR code). 

32. Non-winners or winners of an In-store Prize can also enter the unclaimed prize draw for each Qualifying Transaction they complete by: 

(a)      scanning the QR Code on the game card or visiting the Promotional Website; and 

(b)      following the prompts to complete their entry into the draw, including entering the unique entry code (located on the inside of the game card below the QR code), the requested personal details and agreeing to the Terms and Conditions and the Promoter’s Privacy Policy.

All entries into the unclaimed prize draw must be made by 11:59pm (Sydney time) on 30 September 2025. 

LIMITS AND PROOF OF PURCHASE

33. Multiple game cards are permitted per person, subject to the following: 

(a)        only one (1) initial game card is permitted per Qualifying Transaction; 

(b)      only one (1) additional game card per Bonus Product purchased during the applicable Bonus Purchase Period is permitted in a Qualifying Transaction; 

(c)      only one (1) unique prize code per Online Prize claim is permitted; 

(d)      only one (1) unique entry code per unclaimed prize draw entry is permitted; 

(e)      the same unique code cannot be used more than once; 

(f)       unrecognised, fraudulent or counterfeit codes will be deemed invalid; and

(g)      each Online Prize claim and/or entry into the unclaimed prize draw must be submitted separately and in accordance with entry requirements.

34. Entrants must retain the original game card(s) (clearly showing the unique entry code (applicable to all Entrants) and the unique prize code (applicable to Online Prize winners)) for all claims for Online Prizes as well as all entries into the unclaimed prize draw as proof of purchase and for verification purposes (including for verification purposes of any entries drawn in the unclaimed prize draw).  Failure to produce the original game card(s) for all claims/entries when requested may, in the absolute discretion of the Promoter, result in the invalidation of ALL of an Entrant's entries and forfeiture of any right to a prize.

35. The Promoter reserves the right, at any time, to, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter's discretion.  Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.  The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

36. If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant.

TRANSFER OF GAME CARDS

37. An original game card cannot be transferred by an Entrant who made a Qualifying Transaction to any other person, whether by gift, sale, trade, barter, option or otherwise by “transferring to another”, and whether the transaction was initiated privately or in a public forum, including but not limited to the online option or purchase sites (for example, eBay and Gumtree) or used for any other purpose.  Such online optional purchase sites may not permit the sale of lottery tickets on their sites and also generally prohibit their users from infringing any laws, third-party rights or the policies of the site itself.

38. Any original game card that has been transferred is void and accordingly, and prize claim that includes that original game card that has been so transferred is invalid.  Any person who is a party to such transfer may be refused entry into or disqualified from participating in the Promotion in the Promoter’s sole discretion.

39. Notwithstanding the prohibition on transferring original game cards, the Promoter is not required to establish in any case if the original game card in a prize claim has/have been transferred.

USING THE PROMOTER’S WEBSITES

40. The use of any automated registration or any mechanical, electronic or other means that allows an Entrant to automatically enter the Promotion, claim or register their details repeatedly other than in accordance with these Terms and Conditions is prohibited and will render the registration and all entries and claims by that Entrant invalid.  Entries and claims generated by script, macro, robotic, programmed or any other automated or other means to manipulate or alter the normal function of the Website or any part of the verification process are prohibited and will result in the disqualification of the Entrant and their entry and claim.

PRIZES

41. There is a 1 in 4 chance of winning either an In-Store Prize or an Online Prize.  For the avoidance of doubt, the Promoter does not guarantee that any individual Entrant that receives four or more game cards will win a prize.

43. All prizes are valued in Australian dollars inclusive of GST (if any).  The Promoter takes no responsibility for any variations in the value of a prize over time. 

44. If a prize (or part of a prize) becomes unavailable for any reason beyond the Promotional Partner or Promoter’s responsible control (as applicable), then a comparable prize (or part of a prize) of equal or greater value may be awarded in lieu at the Promotional Partner or Promoter’s discretion, subject to any written directions made under State or Territory legislation.

45. Online Prizes will be delivered (if applicable) to Australian addresses only. 

Save 10c or 20c per litre on fuel*. Max discount $15 for 10c or $30 for 20c discounts:

46. Fuel discount is based on a maximum 150L fill. Discount is valid with a maximum petrol purchase per transaction of 150 litres in one vehicle and approved containers only. Cannot be used in conjunction with any other fuel offer or discount and cannot be used with Shell Card purchases. Excludes LPG and AdBlue®. Customer will be required to surrender a portion of their winning game card to a member of staff at the Participating Outlet so that they can obtain the discount. 

For clarity, fuel discounts can only be redeemed on the winner’s next visit and cannot be redeemed at the same time the Qualifying Transaction is made, nor can they be used for Shell Card transactions. Valid until 30 September 2025.

Flight Centre $5,000 Travel Voucher:

47. Winner will be provided with voucher for allocated amount, being $5,000. This voucher will be valid for 24 months from point of issue. The winner must use the contact details provided by the Promoter for any bookings it wishes to make with the voucher. The winner may not use voucher online or in other Flight Centre stores, other than as directed by the Promoter. The vouchers must be used towards travel products sold by Flight Centre i.e. flights, accommodation, tours, vehicle hire, transfers. The voucher can be used towards one single trip or split across multiple bookings. The voucher cannot be refunded for cash amount and cannot be transferred. If your purchase exceeds the value of the gift voucher, balance must be paid by direct deposit, debit or credit card. Eftpos gift cards are subject to individual merchant acceptance.

If the Swap Card is exchanged for a Retailer Gift Card of higher value, the difference must be paid at checkout. Fees for physical cards or those using EFTPOS, Mastercard or Visa systems, such as a $4.95 issue fee, are not covered by this prize. Information may be disclosed to third parties about the Voucher Code or transactions made with it, as permitted by law and where necessary to operate the code and process transactions. We will accept the Gift Card in accordance with these Terms of Use and any applicable law and subject always to our trading terms.
If you make a booking to redeem your Gift Card you will be advised if the booking is ‘non-refundable or able to be cancelled. You will be advised of the date which you have to be able to cancel the booking. UNCLAIMED PRIZE DRAW

 

67. An unclaimed prize draw for any Online Prize that is won but remains unclaimed or any unwon Online Prize, valued at over $100, will take place at Creata Marketing, 6/3 Central Avenue Thornleigh NSW 2120 on 11:00am (Sydney time) on 31 October 2025.  If the value of the unclaimed prize draw exceeds $10,000, the unclaimed prize draw will be conducted in the presence of an independent scrutineer. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winners will be notified in writing or by email within seven (7) days of the unclaimed prize draw.   

WINNER NOTIFICATION

 

68. All winners will be notified. Each winner of an In-Store Prize will be notified on their original game card. Each winner of an Online Prize will be notified by the Promotional Website upon entering their unique prize code or by email or mail from the Promoter or its nominated agent to the email or mail address provided in: 

(a)      the winner’s prize claim, if the prize was awarded following the receipt of a prize claim; or

(b)      the winner’s unclaimed prize draw entry, if the prize was awarded as part of the unclaimed prize draw.

WINNER PUBLICATION

 

69. Any ACT winners of an Online Prize, SA winners of an Online Prize valued at over $250, or VIC winners of Online Prizes valued at over $1,000 will be published (initial, surname and postcode) online at reddyexpress.com.au/promotions-and-offers on or before 7 October 2025.

70. Each winner in the unclaimed prize draw of a prize valued at over $250.00 (initial, surname and postcode) will be published on reddyexpress.com.au/promotions-and-offers no later than 7 November 2025.

ADDITIONAL ENTRY AND WINNER VERIFICATION

 

71. Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the Promotion and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid.  The Promoter reserves the right to request the Entrant to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the Entrant’s identity, age, residential address, eligibility to enter and claim a Prize (including confirmation that no online auction or purchase sites were used to obtain an entry) and any information submitted by the Entrant in entering the Promotion, before issuing a Prize (including confirming consent of an Entrant’s parent or legal guardian and the name, age and address of the parent or legal guardian that gave their consent, where an Entrant is under 18 years of age). If any documentation required by the Promoter is not provided or an Entrant or entry has not been verified or validated to the Promoter’s (or its nominated agent’s) satisfaction then all the entries of that Entrant may be ineligible and deemed invalid.

72. For each prize claim and entry into the unclaimed prize draw that an Entrant submits, the Entrant must keep the original game card that bears the QR code or the unique prize code submitted at the time of claim or entry (as applicable, where such original game card has not been otherwise surrendered to the Promoter). The Promoter, in its sole discretion, may at any time after a claim or an entry has been submitted, require the original game card to be handed over from the Entrant to the Promoter before awarding any prize in order to verify the claim or entry (as applicable) as eligible under Terms and Conditions. The Promoter also reserves the right, at any time, to request than an Entrant produce original game card(s) in order to verify the Entrant’s entry into the Promotion generally.

73. The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any Entrant for: (a) tampering with the entry, original game cards or prize verification process; (b) submitting an entry which is not in accordance with these Terms and Conditions; or (c) engaging in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion.  The Promoter’s legal right to recover damages or other compensation from such an offender are reserved.

74. A prize will only be awarded following any winner validation and verification that the Promoter, or its nominated agents, requires in their sole discretion.

75. It is a condition of accepting a prize that a winner may be required to sign eligibility form(s), code(s) of conduct and/or legal release(s) in a form determined by the Promoter in its absolute discretion. If a winner is under 18 years of age, the winner must ensure that the winner’s parent or guardian also agrees to and signs such documents (if requested by the Promoter).

PROMOTION MATERIALS – VALIDITY

 

76. The only materials that form part of the Promotion are materials manufactured for the Promoter and issued by the Promoter for the purposes of the Promotion. These official materials include items described in the Promotion material as “game cards” and more specifically “Reddy, Set Peel ‘N’ Win” cards.

77. A game card is only an eligible entry if it has been issued by the Promoter in connection with a Qualifying Transaction.

78. In order to preserve the integrity of the Promotion, and to detect fraudulent and unacceptable conduct, the original game cards have features which are known only to the Promoter and its authorised agents. Only bona fide winnings entries will be honoured. The Promoter may conduct security verification checks in its absolute discretion. An Entry is void and not replaceable if it has been lost, stolen, forged, deleted, mutilated or tampered with in any way or if it, or any part of it, fails any of the Promoter’s security and verification checks.

79. Printing and other quality control errors will not invalidate an otherwise valid prize claim.  Except for fraud or ineligibility under these Terms and Conditions all prize claims in excess of the advertised prize pool will be met. Prizes will only be awarded where an entry fulfills all of the requirements of the Promoter’s verification tests and procedures.  The verification tests and procedures shall be determined by the Promoter in its absolute discretion.

80. Any entry which is misprinted or reproduced incorrectly is voidable, in the Promoter’s sole discretion and the Entrant’s sole remedy will be (subject to availability) a replacement original game card. Entrants may contact Creata Marketing during the Purchase Period if they believe they have received a misprinted or incorrectly manufactured game card. 

81. Calls to Creata Marketing from public telephones or mobiles may incur an additional charge. The charges for all telephone call services will appear on an Entrant’s next telephone or mobile phone bill (if applicable). All queries relating to mobile and telephone bills should be directed to an Entrant’s mobile or telephone carrier. Calls may be recorded for the purposes of promotional security and/or training purposes.

INTELLECTUAL PROPERTY

 

82. For the purposes of these Terms and Conditions, “Intellectual Property Rights” means all present and future rights of whatever nature anywhere in the world including, but not limited to, rights in respect of or in connection with copyright, inventions (including patents), trade marks, service marks, trade names, domain names, designs, confidential information, trade secrets and know-how and similar industrial, commercial and intellectual property rights, whether or not registered or registrable, and includes the right to apply for the registration of such rights, and whether existing in Australia or otherwise.

83. A prize claim and any copyright subsisting in a prize claim irrevocably becomes, at time of submission, the property of the Promoter.  All right, title and interest, including in all Intellectual Property Rights, in all of the entries and in the Promoter’s brands, logos, trading names and products will remain or be vested in the Promoter. Coles Express® is a registered trade mark of Coles Group Limited, used under license by the Promoter. Reddy Express® is a registered trade mark of Viva Energy Australia Pty Ltd. 

84. Participation in the Promotion by an Entrant will not under any circumstances be taken to constitute a transfer, assignment or grant of any ownership rights in any of the game cards, entries or in the Promoter’s brands, logos, trading names and products.

85. The Promoter, on a case by case basis and to the extent required, grants to each Entrant a non-exclusive licence for the Purchase Period and until they claim a prize (if a prize winner) to use the game cards to the extent necessary, to enable the Entrant to participate in the Promotion.

86. All Promotion advertisements depicting third party prizes, prize descriptions and/or trade mark references are illustrative rather than definitive and do not imply any association with the Promoter.

GENERAL

 

87. The Promoter’s decision is final and no correspondence will be entered into at all.

88. Claims and entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible claims or entries will be deemed invalid.  The Promoter accepts no responsibility for late, lost or misdirected claims or entries.  Contact details entered incorrectly for prizes will deem a claim or an entry (as applicable) invalid.

89. The use of any automated claim or entry software or any mechanical, electronic or other means that allows an Entrant to automatically generate unique prize codes or claim or enter repeatedly is prohibited and will render all claims or entries submitted by that Entrant invalid.

90. Any attempt to cause malicious damage or interference with the normal functioning of the Promotion or to otherwise undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws.  Should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law.  If the Promoter suffers loss or incurs any cost in connection with any breach of these terms and conditions or any other legal obligation by an Entrant, the Entrant agrees to indemnify the Promoter for those losses, damages and costs.

91. No compensation will be payable to any person if a winner is unable to submit a prize claim for any reason outside of the Promoter’s control.

92. Winner/s are responsible for ensuring that all prize delivery details provided are correct. The Promoter will not be liable for any costs associated with re-delivery of a prize, should the delivery details provided by a winner be incorrect.

93. Any ancillary costs associated with redeeming a voucher or gift card are not included. Any unused balance of the voucher or gift card will not be awarded as cash. Redemption of the voucher or gift card is subject to any terms and conditions of the issuer including those specified on the voucher or gift card.

94. Any cash prizes will be awarded in the form of a cheque made out in the winner’s name. If a winner cannot accept a cheque, the Promoter may in its absolute discretion, award the cash amount in the form of a prepaid visa debit card.

95. If the winner of an Online Prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf provided valid photo identification is provided by the nominated parent or guardian.

96. Total prize pool value is up to $64,152,032.

97. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.  Prizes must be taken as offered and cannot be varied. Prizes cannot be used or redeemed in conjunction with any other offer.  The Promoter accepts no responsibility for any tax implications from any prize winnings.  Independent financial advice should be sought.

98. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.  The Entrant agrees that, in the event they are a winner, the Entrant will participate in all reasonable promotion activities in relation to the Promotion as requested by the Promoter and its agents and sign any additional documents reasonably required by the Promoter to give effect to this condition. 

99. Any cost associated with accessing the promotional websites is the Entrant's responsibility and is dependent on the Internet service provider used.

100. Instant win game materials void if stolen, forged, mutilated or tampered with in any way.  There will be a total of 16,750,000 game cards printed for this promotion.

LIABILITY

 

101. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents, as well as its franchisees and its associated agencies and companies) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

102. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents, as well as its franchisees and its associated agencies and companies) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: 

(a)      any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);

(b)      any theft, unauthorised access or third party interference;

(c)      any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;

(d)      any variation in prize value to that stated in these Terms and Conditions; 

(e)      any tax liability incurred by a winner or Entrant; or 

(f)       acceptance and/or use of a prize. 

Applicable manufacturers and/or distributors should be contacted in regards to prize warranty claims.

103. Individual Participating Outlets may suspend or cease participation in the Promotion for any reason beyond the reasonable control of the outlet, including safety or participation delays caused by disease, epidemic or pandemic.  If the Promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including because of fraud, disease, epidemic, pandemic, war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other event which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion and/or if necessary to provide an alternative prize or prizes to the same value as an original prize or prizes, subject to any written directions made under applicable State or Territory legislation.

PRIVACY

 

104. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such personal information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities.  Entry is conditional on providing this personal information . The Promoter will also use and handle personal information as set out in its Privacy Policy, which can be viewed at https://www.vivaenergy.com.au/contact/privacy-policy.  In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Entrant.  The Privacy Policy also contains information about how Entrants may opt out, access, update or correct their personal information, how Entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with.  All entries become the property of the Promoter.  As part of its normal operations the Promoter may transfer personal information to Viva Energy companies, associated entities and third parties located in a range of countries in which the Promoter or its contractors operate. The main countries include the United Kingdom, the Netherlands, Malaysia, the Philippines, Japan and the United States of America.

105. Selected partners, promotional agents and prize suppliers of the Promoter (depending on the nature of the prize) (“Promotional Partners”) may require that Entrants provide personal information to them in order to process a valid prize claim/redemption. Entrants must satisfy themselves with the collection statements and privacy policies of any Promotional Partners, as the Promoter will not accept any responsibility for the collection, use and handling of personal information by Promotional Partners.  Entrants also agree to the collection and handling of their personal information by the Promoter’s agency, Creata Marketing Pty Ltd, or its agencies in the event they are a winner of an Online Prize.  Any information collected by Creata or its agencies will be handled in accordance with Creata’s privacy policy, available at https://www.creata.com.au/privacy-policy.

106. An Entrant agrees that the Promoter may, in the event the Entrant is a winner, publish or cause to be published the Entrant winner’s name and locality in any media, as required under the State or Territory lottery legislation.
